Order ?
Curfew Law Intro
Curfew law is a much debatable topic that touches areas
of national and state as well as public policy. Many questions arise when
curfew issues are brought into the public light. How can states impose
curfews without making individuals give up their civil liberties (substantive
theory)? How can it be fair to put restraints on citizens because of their
age? How do we expect children to understand the meaning of freedom when
theirs is taken away? We have to remember that the Constitution is what
gives individuals their freedoms, and any policies imposed that violate
these freedoms causes serious oppositions in the American public.
Basically, curfew is a private family affair. However,
nowadays states and city governments enforce curfew laws. It reflects government
involvement in a private family affair. Should freedom be chosen over order?
Or should order be chosen over freedom? Under the First Amendment, people
are guaranteed, including teen-agers basic freedoms and rights all over
the United States. Under the 14th Amendment, the Constitution respects
everyone's rights no matter how unreasonable they may be. Therefore, curfew
laws violate our Constitutional rights, and that is intolerant. Nonetheless,
city and state governments such as New Jersey, Florida, California, Atlanta,
Dallas, and New Orleans still enforce curfew laws to control the youths
nighttime activities. On the other side, we have supporters of the curfew
laws who believe they are needed to protect children and provide safety
to the community as a whole. So who decides what's best for the community?
This on going debate bears extreme weight to the state and the national
level courts to decide if it's worth to give up individual freedom for
order.
